1. Overview

Lighting Alfresco is a trading name of Skill Launch Labs Pty Ltd (ABN 97 687 286 924) ("Lighting Alfresco", "we", "us" or "our"). We operate lightingalfresco.com and provide the website, content, products, customer support and related services described in these Terms (the "Services"). Our online store is hosted by Shopify.

These Terms, together with the policies linked below, apply when you access the Services or place an order. By using the Services, you agree to these Terms. If you do not agree, do not use the Services.

Nothing in these Terms excludes, restricts or modifies a consumer guarantee, right or remedy that cannot lawfully be excluded, including under the Australian Consumer Law or the New Zealand Consumer Guarantees Act 1993 where applicable.

2. Eligibility and account information

You must be at least 18 years old, or have the permission and supervision of a parent or legal guardian, to place an order. You agree to provide current, complete and accurate account, billing, payment and delivery information.

You are responsible for safeguarding your account credentials and for activity conducted through your account. Notify us promptly if you suspect unauthorised use.

3. Products and electrical installation

We take reasonable care to describe and display products accurately. Colours and appearance may vary depending on screens, lighting and photography. Dimensions, finishes and other specifications should be reviewed before purchase.

Some lighting products require hardwired electrical installation. Where required by law or stated on the product page or instructions, installation, alteration, repair and removal must be performed by an appropriately licensed electrician. Do not install or use a product that appears damaged, unsafe or unsuitable for its intended location or environmental rating.

We may update descriptions, correct errors, limit quantities or discontinue products. These rights do not permit us to mislead customers or avoid obligations relating to an accepted order.

4. Orders and acceptance

Submitting an order is an offer to purchase. We may accept or decline the order for legitimate reasons, including product unavailability, an obvious pricing or description error, inability to verify payment or delivery information, delivery restrictions, or reasonable fraud concerns.

An automated confirmation means we received your order. Acceptance occurs when we confirm dispatch or otherwise expressly accept the order. If we cannot accept a paid order, we will cancel it and refund the amount paid to the original payment method.

5. Prices and payment

Australian customers are shown prices and charged in AUD. New Zealand customers are shown prices and charged in NZD through Shopify Markets. Prices, promotions and availability may change before an order is submitted. The price and complete order total shown at checkout apply to the order.

You authorise Shopify and the relevant payment provider to charge the selected payment method. You confirm that you are authorised to use that method. See our Payment Policy.

6. Shipping and delivery

We provide free standard shipping to eligible street addresses in Australia and New Zealand. Products may be fulfilled by third-party partners, including partners located in China, and an order may arrive in multiple parcels.

Published processing and delivery times are good-faith estimates. We remain responsible for providing remedies required by applicable consumer law if products are not delivered within the promised or a reasonable time. Full details are in our Shipping Policy.

7. Returns, refunds and consumer guarantees

Change-of-mind returns and remedies for faulty, damaged, incorrect, unsafe or misdescribed products are governed by our Returns & Refunds Policy and applicable law.

Our products come with guarantees that cannot be excluded under the Australian Consumer Law. For a major failure, an Australian consumer may be entitled to a replacement or refund and compensation for other reasonably foreseeable loss or damage. For a minor failure, we may choose to repair the product, replace it or provide another remedy within a reasonable time. Corresponding rights may apply to New Zealand consumers under New Zealand law.

8. Promotions and discount codes

Promotions may be subject to additional terms disclosed with the offer. Unless stated otherwise, discount codes cannot be combined, have no cash value and must be applied before checkout is completed. We may refuse or cancel a discount obtained through error, misuse or fraud, subject to applicable law.

9. Intellectual property

The Services and their content, including our name, branding, text, graphics, images, layout and original materials, are owned by or licensed to us and are protected by applicable intellectual-property laws.

You may use the Services for personal, non-commercial shopping purposes. Without our prior written permission, you must not reproduce, republish, distribute, sell, scrape or commercially exploit our content, except where permitted by law.

10. Reviews, feedback and user content

If you submit a review, image, comment or other content, you confirm that it is accurate, lawful, your own or properly authorised, and does not infringe another person's rights. You grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce and display that content for operating and promoting the Services, subject to our Privacy Policy and applicable law.

We may moderate or remove unlawful, misleading, abusive, irrelevant or infringing content. We do not require a positive review and will not present unverified reviews as verified purchases.

11. Acceptable use

You must not use the Services to:

  • break the law or infringe another person's rights;
  • transmit malware, harmful code, spam or deceptive material;
  • interfere with the security or operation of the Services;
  • collect information about others without authority;
  • impersonate another person or misrepresent your identity; or
  • conduct automated scraping or other activity that places an unreasonable load on the Services.

We may restrict access where reasonably necessary to protect the Services, customers or third parties, or to comply with law.

12. Third-party services and links

The Services may use or link to third-party tools, payment providers, carriers and websites. Third-party services are governed by their own terms and privacy notices. We are not responsible for independent third-party websites we do not control, but this clause does not remove any responsibility we have for our fulfilment partners or other parties acting on our behalf.

13. Shopify

Shopify provides the commerce platform that enables us to operate the online store. Purchases are made from Lighting Alfresco, not Shopify. Shopify is not the seller of our products and is not responsible for order fulfilment, product support, returns or refunds.

14. Privacy

Our collection, use and disclosure of personal information are explained in our Privacy Policy. Shopify also processes information as described in its own privacy notices.

15. Disclaimers and liability

To the maximum extent permitted by law, we do not guarantee that the website will always be uninterrupted, secure or error-free. General website content is provided for information and is not a substitute for professional electrical or installation advice.

To the maximum extent permitted by law, neither party is liable to the other for indirect or consequential loss that was not reasonably foreseeable. This limitation does not apply where liability cannot legally be excluded or limited, including liability arising under applicable consumer guarantees, or for fraud, wilful misconduct, personal injury caused by negligence, or other liability that cannot be excluded.

16. Indemnity

To the extent permitted by law, you are responsible for reasonable loss suffered by us as a direct result of your unlawful use of the Services, deliberate infringement of another person's rights, or material breach of these Terms. This does not require you to indemnify us for loss caused by our own breach, negligence or misconduct.

17. Suspension and termination

You may stop using the Services at any time. We may suspend or terminate access if you materially breach these Terms, use the Services unlawfully, threaten security, or expose us or others to material risk. Provisions that by their nature should continue—including intellectual property, liability, dispute and payment obligations—survive termination.

18. Governing law and disputes

These Terms are governed by the laws of New South Wales, Australia. The courts of New South Wales have non-exclusive jurisdiction. This does not deprive a consumer of mandatory rights or protections available under the laws of the place where they live, including applicable New Zealand consumer protections.

19. Changes to these Terms

We may update these Terms to reflect changes to the Services, our practices or legal requirements. The revised Terms will be posted here with an updated date. Material changes apply prospectively and will be notified where required by law.

20. General provisions

If a provision is unlawful or unenforceable, it will be read down to the extent possible or severed without affecting the remaining provisions. A failure to enforce a provision is not a waiver. These Terms and incorporated policies form the agreement governing use of the Services, subject to any additional terms expressly agreed for an order.
